A 90-year-old man will remain in custody after court refused his bail application, citing risks to grand daughters and other children in the community.
The man, who has been in custody since last year, is facing 1 charge of unlawful sexual intercourse contrary to s 97(1) of the Penal Code [CAP 135] and 2 charges of act of indecency with a young person contrary to s 98A of the Penal Code [CAP 135].
His two 9-year-old granddaughters are the complainants.
“I consider that the key primary risks are a risk of interference and a risk of offending,” Supreme Court Judge, Maree MacKenzie stated when denying bail.
She added that the “risk of interference arises from the close family relationships”.
Justice MacKenzie noted that although the defendant proposes to live with his daughter, he will also poses risk to “children in close proximity”.
The defendant allegedly committed the offences in May last year which he partly recorded in his phone.
According to the court he “made admissions to the allegations when spoken to police under caution”.
His age, already serving over a year in custody, and promise to comply with bail conditions are factors advanced for bail.
“I am not persuaded that the risks I have identified can be adequately mitigated by bail conditions, as proposed”, MacKensie concluded.
No trial date has been set for the case.
